Purchase Contract/Agreement

*Deposits are non-refundable but can be transferred to a puppy from another litter.

Full Dislocure - Pickup must be scheduled within 2 weeks once the pup is old enough to leave our home. Failure to schedule pick up or communicate delays to the breeder, results in a forfeiture of any/all paid deposits, payments, etc made and Jnt's Bluegrass Mini Aussies reserves the right to abort sale and make puppy(ies) available to a new family. Boarding fee's will be applied for extra time over 2 weeks past 8 weeks old (@ $35/day) or holding for any amount of time for an adult or adolencent pup.

AKC and microchip Registration will be completed by JnT’s Bluegrass Mini Aussies after contract is filled out with buyers information highlighted above and signed by both parties at the end of the contract. All required information must be provided to accurately register/transfer the puppy/dog to the buyer.

  1. The Buyer agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy/dog parasite free and up to date with vaccinations, proper nutrition, which consists of a good quality food given at regular intervals, and fresh water available at all times. The Buyer promises to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision.
  2. Health Warranty. The puppy/dog was previously examined by a licensed veterinarian and was found to be in good health at that time and has had the immunizations enumerated in the health records provided to Buyer. Buyer, at its own expense, must have the puppy/dog examined by a licensed veterinarian within 72 hours (or a longer period of time with Breeder’s prior written consent if Buyer notifies Breeder that Buyer is unable to obtain an examination because of reasons out of their control (ie. Inclement Weather) of receiving the puppy/dog for the “Examination Period” of the guarantee in this section to be valid. If, within the Examination Period, a licensed veterinarian finds the puppy/dog to be unhealthy or unfit for sale, the puppy/dog may be returned to Breeder for a full refund of the Purchase Price. The veterinarian must provide a written statement deeming the puppy/dog “unfit for purchase”, which must be sent to Breeder within 48 hours of the veterinary examination. The foregoing guarantee expressly excludes any health issues caused by Buyer’s ill-treatment, abuse or neglect, any health issues that result from the puppy/dog’s transportation from Breeder to Buyer and all minor illnesses and health issues, including but not limited to upper respiratory infections, allergic reactions, stress colitis/diarrhea, internal or external parasites or contagious viruses (including canine parvovirus), UTIs, vaginitis or umbilical hernias.
  3. Breeder provides a 1 -year warranty from the puppy/dog’s date of birth against any debilitating congenital conditions.  Health/Genetic testing is done on Sire and Dam prior to breeding. In the event the puppy/dog exhibits symptoms of a suspected debilitating congenital condition, Buyer must immediately inform Breeder and supply any requested veterinary records to Breeder. Breeder will be given the opportunity to take the puppy/dog to a licensed veterinarian of Breeder’s choice for examination.
  4. If at any time the Buyer can no longer retain possession of this dog, the Breeder is to be notified and given first option of resuming full ownership of dog to locate this dog a new home. Refunds, if any, will be at the discretion of the Breeder. The puppy/dog will be returned to Breeder with all AKC registration papers and medical records. Under no circumstances will this dog be sold, leased, traded or given away to any pet shop, research laboratory, animal shelter or similar facility.
  5. The Buyer agrees to contact the Breeder immediately if any questions or concerns arise about the dog, such as housing, diet, or health. The buyer agrees to keep the Breeder informed of any treatment as it occurs. This provides the Breeder with an opportunity to follow up on puppies and gives important feedback and information on the health of our dogs for future generations.
  6. Pet Only Provision: The right to ownership of the puppy/dog is conditioned upon Buyer paying all costs and expenses to spay/neuter the puppy no later than the age of One and a half years old and providing proof of such spaying/neutering to Breeder immediately upon completion. If puppy is bred accidentally before spay, buyer will immediately contact vet and schedule spay as soon as possible. Any breeding occurrence before spay or neuter is complete, or completed after accidental breeding, will entitle JnT’s in the amount of $5,000 as well as any legal fees associated with legal actions for each breeding occurrence.
  7. It is understood at the time of sale that this is a quality dog and it is representative of its breed.
  8. The Seller cannot guarantee the size of the puppy when full grown. The estimate given of full grown size is based on the parents and/or previous litters from the same pairing if such exists.
  9. No guarantees are given on eye color.
  10. No other warranties or guarantees, expressed or implied, are made by Breeder, and the puppy/dog is sold and delivered in an “as is” condition, except as expressly and specifically set forth herein.
  11. This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior or contemporaneous agreements, negotiations, discussions and understandings, written or oral, between the parties with respect to such subject matter. Neither party may assign, transfer, or subcontract any obligations (or rights) under this Agreement without the prior written consent of the other party. No changes, modifications or waivers to this Agreement will be effective unless in writing and signed by both parties. In the event that any provision of this Agreement is determined to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement may be executed in any number of counterparts and such counterparts together shall constitute the same instrument. This Agreement may be executed by electronic signature, which shall be considered as an original signature for all purposes and shall have the same force and effect as an original signature.

 

Buyer’s breach of any of the foregoing obligations shall result in Breeder’s warranties set forth in this Agreement being null and void.

 

 

The preceding paragraphs contain conditions established by the Breeder to ensure the well-being of the puppy. The Buyer’s agreements will continue for the duration of the dog’s life and the Breeder has the right to enforce agreements.
